The Legal Department deals with co-ordinating legislative drafting in the Ministry’s field of administration, checks compatibility of the acts drafted in the Ministry’s field of administration with the Constitution, all in accordance with rules of legislative drafting. The Department gives legal advice to the Ministry’s officials and subordinate state agencies. It also keeps records on state agencies, state enterprises and government invested enterprises in the Ministry’s field of administration. Gathers data concerning court representation of the state in environmental matters and submits those data to the Ministry of Justice as stipulated by the Government of the Republic. Co-ordinating legislative drafting entails, in co-operation with other structural units, the preparation of a legislative drafting plan for the Ministry’s field of administration and ensuring its implementation. The Department also ensures harmoniztion with the Ministry of Justice of the Ministry of the Environment’s legislative drafting plans. Lawyers of the Legal Department participate in drafting legislation of the Ministry of the Environment’s field of administration. Furthermore, to ensure compatibility with the Constitution and adherence to rules of legislative drafting, the Legal Department reviews all legislation drafted in the Ministry’s field of administration, presenting its assessment and legal opinion. The department sees that all draft legislation pending for the Ministry of the Environment’s approval is conveyed to the appropriate structural units and subordinate agencies, and prepares instruments of approval of the draft legislation. |
