Producers Liable for Waste Electrical and Electronic Equipment

Today, on 22 December the Government of the Republic approved the draft regulation on the labelling of electrical and electronic equipment and requirements for collection, returning to the manufacturer, recovery or disposal of waste electrical and electronic equipment and the relevant target indicators and terms for achievement thereof.

The regulation provides the basis for waste management of electrical and electronic equipment as a type of product of concern. Pursuant to the Waste Act, the producer is liable for collection and handling of waste resulting from products of concern. A “product of concern” means a product the waste resulting from which causes or may cause health or environmental hazards, environmental nuisances or excessive pollution of the environment.

The direct expenses of producers arising from the implementation of the regulation are mainly related to the development, launching, maintenance and financing of the collection, recovery and disposal system(s).

The producers of electrical and electronic equipment have to provide the distributed equipment with information identifying the producer and a separate collection labelling. The labelling has to be clearly legible until the equipment becomes waste.

Users of electrical and electronic equipment will get the necessary information about equipment returning places, the meaning of separate collection labelling and possible impacts of dangerous substances contained in the equipment from points of sale of such equipment.

Distributors of electrical and electronic equipment meant for household use are required to take back from the owner any waste electrical or electronic equipment of the same type and purpose as the equipment distributed by them.

A regulation on this matter will be enacted for the first time and it will enter into force in three days after publication in the State Gazette.
